3. Purpose of data processing
avitea processes the data you have sent us in connection with your application in accordance with Section 6 Para. 1 (a) and (b) GDPR in order to check your suitability for the position and to carry out the application procedure.
4. Legal basis for data processing
The legal basis for processing your personal data in this application procedure is primarily Section 26 German Data Protection Act (BDSG) in the version applicable as of May 25, 2018. According to it, the processing of data required in connection with the decision on the establishment of an employment relationship is permissible.
Should the data be required for legal prosecution after completion of the application process, data processing may be carried out on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests pursuant to Art. 6 (1) (f) GDPR. Our interest in that case would consist of asserting or defending claims.
5. Categories of personal data
As part of our application process, we collect and process personal data about you as an applicant, for example
- Identification data: we may process your name, contact details (including home address, home and cell phone number), nationality and country of residence, date of birth, gender (in exceptional cases), digital signature and the languages you speak as part of your application.
- CV and other personal information: we may process your CV, employment history, information about your skills, experience and educational background and other relevant information (e.g. religious affiliation).
- We may process identifiers issued by government authorities, including (but not limited to) identity card number, social security number and pension number, to the extent required by law.Photos and video recordings may be processed and stored in connection with your application and forwarded to third parties (companies) for the purpose of hiring out employees. This also applies to video applications.
- As part of a job interview and when you enter our building, we may record your name, contact details, license plate number and other identifying features for security reasons. If we are legally obliged to do so, we may also ask you to disclose information about your medical condition (including information about viral infections, flu, etc.) for health and safety reasons.
Further information: Other personal data not listed may be processed if we are provided with it voluntarily by you.
All listed data is collected from you directly or indirectly, for example by e-mail, form, by uploading a CV or an application video. In this way, you voluntarily provide us with the information and thus give your consent to the processing of your personal data in accordance with Art. 6 para. 2 lit. a).
6. Data sources
We process the personal data that we receive from you in the course of contacting you or your application via the online application form, by e-mail or by post.
7. Correctness of the information
For your part, you ensure that all the personal data submitted at the time of your application is truthful, correct, unambiguous and current. You have the opportunity to correct your own information to ensure that it is up to date.
8. Recipients of the data
Your data is stored in encrypted form in a data center in the Federal Republic of Germany. Your data will neither be sold nor made available to other unauthorized third parties.
We only pass on your personal data within our company to those areas and persons who need this data to fulfill contractual and legal obligations or to implement our legitimate interest. After we receive your application, your application data will either be viewed by the department responsible for the application process or checked by an AI and, if necessary, completed by contacting you. Suitable applications are then forwarded internally to the department responsible for the respective open position or forwarded to vacant positions via AI. The further process is then coordinated. To protect your data, avitea employees are bound to data secrecy.
We may transfer your personal data to companies affiliated with us to the extent that this is permissible within the scope of the purposes and legal bases set out in numbers 3 and 4 of this data privacy declaration sheet.
avitea also uses a specialized software provider (HR4You Solutions GmbH & Co. KG) for the application process. This provider acts as a service provider for avitea and may also obtain knowledge of your personal data in connection with the maintenance and servicing of the systems. avitea has concluded a commissioned data processing agreement with this provider, which ensures that the data is processed in a permissible manner.
avitea also uses Mona Ai GmbH, Campus Universität des Saarlandes Starterzentrum Gebäude A1 1, 66123 Saarbrücken, Germany, for the application process. They are legally represented by Felix Adam, Denis Franz. Their data protection officer can be contacted via heyData GmbH, Schützenstraße 5, 10117 Berlin, www.heydata.eu, e-mail: datenschutz@heydata.eu. Mona Ai GmbH acts as a service provider for avitea and may also obtain knowledge of your personal data in connection with the maintenance and care of the systems. avitea has concluded a so-called order data processing contract with this provider, which ensures that the data processing is carried out in a permissible manner.
Otherwise, data will only be passed on to recipients outside the company if this is permitted or required by law, if the transfer is necessary to fulfill legal obligations, or if we have your consent. As a rule, disclosure to third parties is considered acceptable in the case of customer companies that have commissioned avitea to fill the respective position, insofar as this is necessary for the placement of activities. Your data will be forwarded by us exclusively for the purpose of carrying out the application process and limited to the scope required in the process. Only the persons responsible for filling the respective vacancy have access to your data. Here, too, an appropriate level of data protection is ensured.
9. Transfer to third countries
This information shall not be shared with third countries.
10. Duration of data storage
We store your personal data as long as this is necessary for the decision on your application. Your personal data or application documents will be deleted a maximum of 6 months after the end of the application process (e.g. notification of the rejection decision), unless longer storage is legally required or permitted. We store your personal data beyond that only insofar as this is required by law or in the specific case for the assertion, exercise or defense of legal claims for the duration of a legal dispute
If you agree to further storage of your personal data in our applicant database and would like to receive further job offers (see the checkbox "I would also like to receive other job offers" below), avitea will automatically delete your data after 24 months at the latest, unless you have agreed to longer storage.
If you are awarded a position during the application process, the data will remain in our system.
11. Your rights as a "data subject"
You have the right to obtain information on your data in written or electronic form and the right to request that avitea transfer this data. Furthermore, you have the right at all times to have any personal data blocked or deleted, to object to the processing of data or to restrict processing, and you also have the right to have incorrect data rectified. (Note: Whenever country-specific, legal retention periods are to take effect or if the data and application documents continue to be needed by the applicant to avert, where necessary, any asserted claims, the data/documentation will be blocked prior to deletion for a period set down by the particular country.)
If the processing of data is based on your consent, you are entitled to revoke your consent to the use of your personal data at any time in text form in accordance with Art. 7 GDPR. In such cases, please send an e-mail to this address: info@avitea.de. Please note that the revocation is only effective for the future. This means that any processing that took place before the revocation remains lawful and is not affected by it. Please also note that we may need to retain certain data for a specific period of time to comply with legal requirements. The same applies to data processing on the basis of other authorization facts after receipt of the revocation.
If you think that the processing of your data breaches applicable law, in accordance with Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority.
12. Provision of personal data
The provision of personal data in the context of application processes is neither legally nor contractually required. You are therefore not obliged to provide information about your personal data. Please note, however, that data are required for the decision on an application or the conclusion of a contract in relation to an employment relationship with us. Unless you provide us with personal data (i.e. consent to data storage), we cannot make a decision to establish an employment relationship. Your application will not be processed further.

There is no automatic decision making and profiling.
14. Changes to this privacy policy
We reserve the right to amend this privacy policy with effect for the future. A current version is always available here.
